Advance on maintenance

Eligibility

A child is entitled to maintenance advance if it

1. has not yet reached the age of twelve and
2. lives in Germany with one of his parents, who
   • is single, widowed or divorced or
   • lives permanently separated from his/her spouse or partner or whose spouse or partner is likely to be accommodated in an institution for at least 6 months and
   • does not receive maintenance from the other parent, or does not receive it regularly, at least in the amount specified in Section III.
3. From 01.07.2017, there is also an entitlement to maintenance payments until the child reaches the age of eighteen if:
   • the child does not receive any benefits under the Second Book of the Social Code or the child's need for assistance under § 9 of the Second Book of the Social Code can be avoided by the maintenance payment or
   • the parent according to paragraph 1 number 2 has income within the meaning of § 11 paragraph 1 sentence 1 of the Second Book, with the exception of child benefit

The determination of the avoidance of the need for assistance and the amount of income in accordance with sentence 1 shall be based on the Jobcenter's decision for the month in which the child reaches the age of twelve, the decision for this month if the application is submitted at a later date and the last decision announced for this month in the event of a review at a later date. The respective determination is effective for the period from the respective month up to and including the month of the next review.
The children's income from reasonable work and/or assets is taken into account if they are no longer attending a general school.
Special provisions apply to foreign children in accordance with Section 1 (2a) of the Maintenance Advance Act (Unterhaltsvorschussgesetz).

Amount of the maintenance advance

After deducting the child benefit to be paid for a first child, the following advance maintenance amounts will result from 01.01.2025:

Advance maintenance payments are made until the child reaches the age of 18 at the latest.

Applying for benefits

Local jurisdiction is determined by the place of residence of the parent with whom the child lives.
