New specifications

Due to the specific situation in the Soers, the applicable regulations in the landscape protection areas of the city of Aachen are to be extended by additional stipulations for the Soers area; the same applies to exemptions. Furthermore, the amendment provides for the designation of additional protected landscape features (orchards, spring catchment areas, gorse and copses, watercourses), the creation and expansion of orchards, the creation of near-natural watercourses and the establishment of 2 floodplains. In addition, natural monuments that no longer exist are to be removed from the list and hiking trails that are no longer needed are to be planned.

For reasons of species conservation, the existing and new orchards are to be further developed as additional little owl biotopes in order to ensure the continued existence of this cultural successor.

Process status

At its meeting on 15.01.2009, the planning committee instructed the administration to carry out public participation. Public participation in accordance with Section 27b LG took place in the period from 15.06.2009 to 26.06.2009 inclusive. On 02.03.2011, the City Council decided to put Amendment No. 20 to the 1988 Landscape Plan of the City of Aachen - Soers Cultural Landscape - on public display in accordance with Section 27c LG. The Aachen-Laurensberg district council on 02.02.2011 and the planning committee on 17.02.2011 recommended this decision.

The draft of amendment no. 20 to the 1988 landscape plan of the City of Aachen was open to the public from 30.05.2011 to 01.07.2011.

Explanations

In order to safeguard and further develop a high-quality cultural landscape and to protect the ecologically valuable components of the Soers, further specific stipulations are to be made regarding the "L1" landscape conservation area with prohibitions and prohibitions, the creation and addition of orchards to strengthen the little owl territories, the creation of near-natural water bodies and the development of floodplains of the torrent.

Natural monuments in the landscape plan that either no longer exist or have already been removed for reasons of hazard prevention with the approval of the Lower Landscape Authority are to be removed from the list and abandoned plans for hiking trails are to be deleted.

In addition, the exemptions are to be adapted in such a way that they recognize the special nature of the "L1" landscape conservation area. The aim is to ensure that only measures based on an agricultural privilege in accordance with Section 35 BauGB are subject to a general exemption.

In amendment procedure no. 20 to the landscape plan, the designation map and the textual representations and textual designations with explanatory report are to be expanded or amended in accordance with the planned measures, so that the current designations under 3.2.2 Landscape conservation areas - L1 - are to be supplemented, the location of individual natural monuments under 3.2.3 corrected and removed, under 3.5.10, 3.2.4 Protected landscape features of LB 105 are removed and new protected landscape features (LB) are designated instead, under 3.5 Development, maintenance and development measures 3.5.13 Creation and addition of orchards, 3.5.14 Creation of near-natural watercourses and 3.5.15 Development of floodplains of the torrent are shown and specified.
