Process status

At its meeting on September 2, 2010, the planning committee decided to initiate the repeal procedure for implementation plan no. 469 I. At the same time, it decided to publicly display the plan to be repealed in accordance with Section 3 (2) BauGB.

Explanations on planning

It can be assumed that implementation plan no. 469 I will not stand up to judicial review due to a publication error. According to the case law of the Federal Administrative Court, a development plan (former implementation plan) that has been recognized as invalid must be annulled in order to remove the appearance of its legal validity. In order to establish legal certainty, implementation plan no. 469 I is to be repealed.
