Anyone planning to demolish existing buildings or other structural elements as part of a construction project must comply with various environmental regulations. Night work

Exemption permits for night work (State Immission Control Act)

The protection of the night's rest is regulated in the State Immission Control Act.

Between 10 p.m. and 6 a.m., activities that disturb the night's rest are prohibited.

This does not apply to measures to prevent or remedy an emergency.

In addition, the competent authority may grant exceptions to the ban upon request if the exercise of the activity during the night is in the public interest or in the overriding interest of one of the parties involved.

Typical examples of public interest are maintenance work on public supply and disposal systems or the tracks of transportation facilities.


Notes on the application documents / decision on the application

By submitting the application at an early stage and by enclosing all necessary documents that prove the necessity and scope of the night work as well as the public interest of one of the parties involved, the applicant contributes to a quick processing of the application.

The reasons for night work must be easily comprehensible and plausible in order to avoid queries.

Due to the staffing situation and the large number of applications, it can be assumed that applications received at short notice (less than 5 working days) cannot be processed in good time.

If an exemption has been granted, residents must be informed in writing in good time about the nature and duration of the work. Contact persons who can be reached by telephone must be named.

Permits
